Florida Woman’s Flood Insurance Claim Was Denied Due To This Unfair Loophole
Wow, this is very devastating and my heart breaks for her. ” Florida woman’s flood insurance claim was denied due to this unfair loophole!” In Florida, having flood insurance is a must. Hurricanes and tropical storms happen often and even if your area does not get hit directly, storm surge is very real. Hurricane Helene did not hit St. Petersburg directly but my living room got flooded. Danielle Jensen, who also lives in Pinellas County was affected by Tropical Storm Debbie in Early August. Jensen thought her home was protected because of the flood insurance that she had. She was shocked to find out that her claim had been denied.
Florida Woman Devastated After Finding Out Her Flood Insurance Claim Was Denied
Tropical Storm Debby came through Pinellas County in August of this year. Danielle Jensen believed her home was protected with flood insurance from the National Flood Insurance Program! She had every right to think that, seeing that she paid $8600 on a policy that was administered directly by FEMA. Sadly when she made her insurance claim, she later found out it was denied. How and why did this happen? How can someone be denied if they have an active policy?
Jensen told WFLA News Chanel 8 that after she filed the claim, insurance adjusters came through and denied it outright. It wasn’t denied because of her, but a prior loss report. The previous owner filed a flood insurance claim but did not complete the repairs after the payout. The serial numbers on appliances were the same from the previous insurance claim. This ended up leaving her family on the hook for close to $100k in damages.
There is one major problem with NFIP participating communities, and it is that federal law doesn’t require disclosure of a previous flood insurance claim or any of the outcomes. Any disclosure of claims and information without the consent of the claimant or current homeowner was seen as a violation on the privacy act. That is changing October 1st , when the new law goes into effect!
